How to harmonize the registration of old documents with the digital cadastre

The Republic Geodetic Authority (RGA) has effectively established a system of registration of rights to real estate, distribution of data and archiving of the collection of documents.

RGA is also ready to support the final overcoming of the decades-old "stumbling block" in determining the rights of other state bodies such as courts, notaries, and local governments and others. The Republic Geodetic Authority, as the first among state bodies, using modern communication channels, ZOOM platform, YouTube and other social networks, has launched an initiative concerning a fundamental problem, which is resolving cases according to old documents, said the head of the second instance department. Milos Bjelanovic at the second online discussion organized by the Republic Geodetic Authority on the topic "Communication with the digital cadastre and how to solve the registration in the cadastre on the basis of old documents".


"Currently, we have the most up-to-date real estate registry in Serbia ever," said Dr. Milos Zivkovic, a professor at the Faculty of Law in Belgrade, during the discussion, when it comes to the so-called "New" documents.

The Vice President of the Belgrade Bar Association, Sasa Ivanisevic, stated that the bar would be happy to get involved in solving the problem of determining rights on the basis of old documents so that their registration in the real estate cadastre would be possible and efficient. He emphasized that the digital services of RGZ are very well designed in the technical sense, but that they should be constantly monitored and improved, in accordance with the needs of users.


Milos Bjelanovic from RGZ pointed out that registration in the cadastre is the only reliable and transparent way of acquiring and proving property rights to real estate. Since the entry into force of the new Law on the Procedure for Registration in the Real Estate Cadastre and Lines in 2018, the digital method of communication and mandatory registration in the cadastre has been applied, which enabled more efficient work and prevented manipulations and fraud.


The common position of the participants in the discussion is that a good legal basis is key to systematically overcoming problems inherited from the past, that advocacy is a great and little used potential to solve these problems, and that involving lawyers in solving cases and forming a special body or commission. which would be given the role of a mechanism for preliminary determination of rights, would be one of the possible solutions.

By organizing this discussion, the RGA continued the tradition of transparent communication with citizens and the economy on all issues and challenges we face and reaffirmed that the initiator and leader among public administration bodies is in the process of digitizing services and expects other institutions to follow a positive example, obviously gives results.
